These Terms & Conditions govern the access to and use of the SonoHeart Music website and the services provided through it. By accessing this website or engaging with any SoundHeart Music service, you agree to these Terms in full.

1. Nature of the Service

SonoHeart Music offers custom, original musical works created from cardiac frequency recordings provided voluntarily by individuals or, in the case of minors, by their parents or legal guardians.

The service is:

  • Artistic and experiential

  • Non-clinical

  • Non-therapeutic

  • Non-diagnostic

SonoHeart Music does not provide medical, psychological, or healthcare services of any kind.

2. Eligibility and Responsibility

Adults

By submitting cardiac recordings and engaging with SoundHeart Music, you confirm that:

  • You do so voluntarily

  • You understand the artistic nature of the service

  • You assume full responsibility for how the music is listened to and used

Minors

When the service involves a minor:

  • All data submission must be made by a parent or legal guardian

  • The parent or legal guardian assumes full responsibility for:

    • Data submission

    • Listening conditions

    • Interpretation and use of the musical work

SonoHeart Music is not responsible for how adults or minors emotionally, psychologically, or physically experience the music.

3. The Creative Process

Each musical work follows a structured, human-led process that includes:

  1. Reception of Cardiac Data
    Voluntary submission of cardiac or heart-related sound recordings.

  2. Analytical Phase
    Scientific and technical analysis using tools such as spectral analysis (FFT), acoustics, frequency mapping, harmonic structures, and specialised software, with supportive use of AI-based analytical tools.

  3. Artistic Composition
    A fully human, artistic and aesthetic composition phase, shaped by decades of musical experience. Each piece is a unique, non-repeatable original work.

  4. Delivery
    Final mastering and delivery of the musical work.

4. Delivery Timeframe

Delivery time is approximately 10 to 15 business days, starting from the moment:

  • All required data has been correctly received, and

  • Any necessary clarifications have been completed.

Delivery times may vary slightly depending on:

  • Data quality

  • Technical complexity

  • Artistic process requirements

SoundHeart Music will inform you if delays occur.

5. Formats and Delivery Method

Each completed work is delivered digitally and includes:

  • WAV format
    48 kHz / 24-bit (high-quality master audio)

  • MP3 format
    320 kbps (for personal, everyday listening)

Files are delivered via secure digital means (email or download link).

6. Intellectual Property

All musical works created by SonoHeart Music are original compositions.

  • Copyright remains with the composer.

  • Clients receive a personal, non-commercial listening license.

  • The music may not be:

    • Resold

    • Redistributed

    • Used commercially

    • Modified or publicly performed without written consent

Each work is created exclusively for the individual recipient.

7. No Guarantees or Claims

SonoHeart Music does not guarantee:

  • Emotional outcomes

  • Psychological effects

  • Therapeutic results

  • Medical or health-related benefits

Any personal experience arising from listening to the music is subjective and individual.

8. Limitation of Liability

To the fullest extent permitted under EU law:

  • SoundHeart Music shall not be liable for:

    • Emotional responses

    • Psychological interpretations

    • Physical sensations

    • Decisions made based on personal experiences with the music

Use of the music is entirely at the discretion and responsibility of the listener, or of parents/legal guardians in the case of minors.

9. Accessibility and Use

The website is designed in alignment with European accessibility principles (EAA). However:

  • SoundHeart Music is not responsible for individual device limitations

  • Users are responsible for ensuring appropriate listening environments and volume levels

10. Privacy and Data Protection

Personal data and cardiac recordings are handled in accordance with the Privacy Policy and in full compliance with:

  • GDPR (EU Regulation 2016/679)

  • Applicable Irish and European data protection laws

11. Governing Law and Jurisdiction

These Terms & Conditions are governed by the laws of the European Union and Ireland.

Any disputes shall be subject to the exclusive jurisdiction of the competent courts of Ireland.
